GENERAL INFORMATION ON REACH

Regulation (EC) 1907/2006 on the Registration, Evaluation and Authorisation of Chemicals ("REACH") is a European Union Regulation that came into force on June 1, 2007. It defines various measures to limit the use of certain hazardous chemicals and regulates consumer exposure to such chemicals. Under REACH, companies operating in or supplying into the EU face various legal obligations, including responding to questions from end consumers on whether certain listed substances are present in their products, and if so, providing sufficient information to allow safe use.

TORA & TORY is aware of the steps required to comply with REACH where applicable to our products and acts accordingly.

NOTIFICATION FOR SUBSTANCES OF VERY HIGH CONCERN IN ARTICLES

If an article contains a so-called Substance of Very High Concern (SVHC) in a concentration above 0.1% weight by weight, consumers may request information about this fact, the name of the specific SVHC, and information about the safe use of the article.

TORA & TORY has not been made aware by any of our suppliers that any component of a TORA & TORY article contains any SVHC in a concentration above 0.1% weight by weight. 

We re-evaluate this statement with every amendment of the SVHC list published by the European Chemicals Agency (ECHA), and with any new information concerning SVHCs relevant to our products.

WHAT IS TORA & TORY DOING TO BE PREPARED FOR REACH?
Our team monitors REACH requirements and works to ensure a smooth transition into any new regulatory requirements, so as to avoid unnecessary disruption in the supply of TORA & TORY articles.

WHAT ARE SVHCs?
A Substance of Very High Concern (SVHC) is a chemical substance (or part of a group of chemical substances) for which it has been proposed that use within the European Union be subject to authorization under the REACH Regulation. Listing of a substance as an SVHC by the European Chemicals Agency (ECHA) is the first step in the procedure for restricting the use of a chemical. The list of SVHCs is regularly updated, and the most recent list is published on the ECHA website.

NOTIFICATION FOR SUBSTANCES IN ARTICLES
REACH regulates that if an article contains an SVHC above 0.1% weight by weight concentration, the supplier of the article shall provide the recipient with sufficient information to allow safe use of it, including, at a minimum, the name of the SVHC contained in the article. Such information is provided free of charge. With regard to TORA & TORY products, please see our statement above.

HAS TORA & TORY REGISTERED THE SUBSTANCES IN MY PRODUCT?
Where required, TORA & TORY registers or seeks confirmation of compliance for substances manufactured in or imported into the European Union. For chemicals and articles sourced in the EU, TORA & TORY may act as a downstream user. As such, we seek communication with our suppliers to ensure that key raw materials and manufacturing processes meet applicable requirements. We cannot, however, guarantee that our suppliers register all their products or account for our specific uses. Should issues in our supply chain arise, TORA & TORY will work with its suppliers to resolve them.

WHAT IS A DOWNSTREAM USER?
A downstream user means any natural or legal person established within the Community, other than the manufacturer or the importer, who uses a substance — either on its own or in a preparation — in the course of industrial or professional activities. A distributor or a consumer is not a downstream user.

WHAT SHOULD I DO AS A DOWNSTREAM USER OF TORA & TORY ARTICLES?
Risk assessment of chemical use plays a central role in the REACH concept and requires the exchange of information between supplier and downstream user. Generally, no immediate action is required by you. If you use our articles in a way that is contrary to their intended application, or in a way you suspect we have no knowledge of, you may wish to let us know through the contact details below.

HOW ARE SVHCs IDENTIFIED?
The identification of SVHCs is a multi-step process:

* An EU member state prepares a document detailing why it believes a dangerous substance is of "very high concern." This is usually done on the initiative of the competent authority of a member state, not in public.
* ECHA collects these documents and publishes them on its website as a "consultation," which happens multiple times a year. At the end of the consultation, a consensus is reached on whether to include the substance on the SVHC list.

WHERE CAN I FIND THE MOST RECENT LIST OF SVHCs?
The list of SVHCs is published and regularly updated by ECHA, and can be reviewed on the ECHA website.
